Welcome to ShortX.me! These Terms of Service ("Terms") govern your access to and use of the ShortX.me website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

  • Prohibited Conduct: You agree not to engage in any of the following prohibited activities:
    • Using the Service for any illegal or unauthorized purpose.
    • Creating short links that redirect to malicious, fraudulent, or illegal content.
    • Engaging in spamming, phishing, or distributing malware through shortened links.
    • Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
    • Using any automated system (e.g., robots, spiders) to access the Service in a manner that sends more request messages to the ShortX.me servers than a human can reasonably produce in the same period by using a conventional web browser.
    • Collecting or harvesting any personally identifiable information, including account names, from the Service.
    • Impersonating another person or otherwise misrepresenting your affiliation with a person or entity.
    • Violating our Acceptable Use Policy.
  • API Usage: If you use our API, you agree to adhere to the specific API terms and rate limits outlined in our documentation and your chosen plan. Abuse of the API may result in suspension or termination of your account.

5. Intellectual Property

  • ShortX.me Content: All intellectual property rights in the Service, including but not limited to software, design, text, graphics, logos, and trademarks, are owned by ShortX.me or its licensors.
  • Your Content: You retain all rights to the original URLs and any content you provide to the Service. By using the Service, you grant ShortX.me a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your content solely for the purpose of providing and improving the Service.

6. Data and Analytics

  • Data Collection: You acknowledge and agree that ShortX.me collects data related to the use of your shortened links, including but not limited to click counts, IP addresses, geographic location, device information, and referrer data. This data is collected to provide you with analytics and to improve the Service.
  • Data Ownership: While ShortX.me collects and processes this data, you retain ownership of the analytics data generated from your links.
  • Privacy: Our collection and use of data are governed by our Privacy Policy.

7. Disclaimers and Limitation of Liability

  • Service "As Is": The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. ShortX.me does not warrant that the Service will be uninterrupted, secure, or error-free.
  • No Guarantee of Uptime: While we strive for high availability, ShortX.me does not guarantee 100% uptime and may experience occasional downtime for maintenance or unforeseen issues.
  • Limitation of Liability: To the maximum extent permitted by law, ShortX.me shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

8. Indemnification

You agree to defend, indemnify, and hold harmless ShortX.me and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property right or privacy right; or (d) any claim that your content caused damage to a third party.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in San Francisco, California, in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

10. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and ShortX.me regarding the Service.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
  • No Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and ShortX.me's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
